A USPTO trademark application costs $350 per class of goods or services when filed online. Surcharges add $100 per class for insufficient information and $200 per class for free-form descriptions. An intent-to-use filing adds $150 per class later. These fees took effect on January 18, 2025. Attorney fees are separate.

What Is the USPTO Trademark Registration Cost?
The USPTO trademark registration cost is the set of government fees you pay to apply for and register a federal trademark, starting with a base application fee of $350 per class.
The United States Patent and Trademark Office (USPTO) charges by class. A class is a category of goods or services, and there are 45 of them. The USPTO gives this example: golf shirts, dress shirts and t-shirts all sit in one class, so the base fee is $350. Add a custom t-shirt printing service and you have two classes, so the base fee is $700.
The fee structure changed on January 18, 2025. The USPTO replaced the old TEAS Plus ($250) and TEAS Standard ($350) options with one base application fee and a set of surcharges. Any page that still quotes a $250 filing fee is out of date.
The government fee is not the whole budget. An attorney, a clearance search or a filing service is a separate cost that you choose. This calculator keeps those as your own inputs because the USPTO does not publish prices for them.
How Does the Trademark Cost Calculator Work?
The calculator multiplies each USPTO fee by the number of classes it applies to, then adds the costs you typed.
Total = (350 x classes) + (100 x incomplete classes) + (200 x free-form classes) + (200 x extra character groups) + intent-to-use fees + attorney + otherIntent-to-use fees = (150 x classes) + (125 x classes x extensions)- Base fee. Classes x $350.
- Surcharges. $100 for each class with insufficient information, $200 for each class that uses the free-form text box, and $200 for each extra group of 1,000 characters in that box.
- Intent to use. Classes x $150 for the statement of use, plus classes x $125 for every six-month extension request.
- Your costs. The attorney fee, flat or per class, plus other costs.
Maintenance is shown apart from the total because it falls due years later. The first 10 years cost $975 per class: $325 for the Section 8 declaration and $650 for the combined Section 8 declaration and Section 9 renewal.
Trademark Registration Cost Examples
One class, already in use, self-filed. 1 x $350 = $350. There are no surcharges and no later use fee.
Two classes, one with custom wording, with an attorney. Base fee 2 x $350 = $700. Free-form surcharge 1 x $200 = $200. With an example attorney quote of $1,000, the total is $1,900. The attorney figure is only an example. Use your own quote.
Three classes, intent to use, two extensions. Base fee 3 x $350 = $1,050. Statement of use 3 x $150 = $450. Extensions 2 x 3 x $125 = $750. USPTO fees come to $2,250 before any attorney cost.
A registration fee is a one-off cost in a launch budget. The startup runway calculator shows how it changes your months of cash.
Factors That Change Your Trademark Cost
Five things move the total: classes, completeness, wording, filing basis and who prepares the application.
Number of Classes
Every USPTO application fee is per class. Two classes double the base fee, the statement of use fee and each maintenance fee.
Completeness of the Application
The USPTO adds $100 per class when an application lacks required information. The base application requirements are listed in 37 CFR 2.22(a).
How You Describe Goods and Services
Picking entries from the Trademark ID Manual costs nothing extra. Typing your own description in the free-form text box adds $200 per class, plus $200 for each additional 1,000 characters beyond the first 1,000.
Filing Basis
An intent-to-use application needs an amendment to allege use or a statement of use before it can register. Either one costs $150 per class. Each six-month extension request costs $125 per class.
Attorney or Self-filing
The USPTO says your application fees stay the same with an attorney, but your overall cost is higher because you also pay for the attorney. Applicants domiciled outside the United States must be represented by a US-licensed attorney.
USPTO Trademark Fees Compared: Filing vs Maintenance Costs
Filing fees are paid once, at the start. Maintenance fees return for as long as you keep the registration. All amounts below are per class for electronic filing.
| USPTO fee | Amount per class | When it is due |
|---|---|---|
| Base application (Sections 1 and 44) | $350 | At filing |
| Insufficient information surcharge | $100 | At filing or during examination |
| Free-form text surcharge | $200 | At filing or during examination |
| Each extra 1,000 characters of free-form text | $200 | At filing or during examination |
| Amendment to allege use or statement of use | $150 | Intent-to-use filings, before registration |
| Six-month extension to file a statement of use | $125 | Each request, up to 5 |
| Section 8 declaration of use | $325 | Between years 5 and 6 |
| Combined Section 8 declaration and Section 9 renewal | $650 | Between years 9 and 10, then every 10 years |
| Section 15 declaration of incontestability | $250 | Optional |
| Grace period fee, Section 8 or Section 9 | $100 each | When filed in the six months after a deadline |
Two other filing routes cost more. A paper application is $850 per class. A Madrid Protocol application filed through WIPO under Section 66(a) is $600 per class.
Cost by Number of Classes
| Classes | Base filing | Filing plus statement of use | Year 5 to 6 | Year 9 to 10 |
|---|---|---|---|---|
| 1 | $350 | $500 | $325 | $650 |
| 2 | $700 | $1,000 | $650 | $1,300 |
| 3 | $1,050 | $1,500 | $975 | $1,950 |
| 4 | $1,400 | $2,000 | $1,300 | $2,600 |
| 5 | $1,750 | $2,500 | $1,625 | $3,250 |
| 10 | $3,500 | $5,000 | $3,250 | $6,500 |
When to Use a Trademark Cost Calculator
Budgeting a New Brand
A founder pricing a launch needs the government fee and the attorney quote in one number. Enter both and copy the report into the budget.
Choosing How Many Classes to File
Each added class repeats the base fee and every later fee. Change the class count to see what a wider filing costs now and at renewal.
Planning an Intent-to-use Timeline
Extensions buy time but cost money. Five extensions on one class add $625. The USPTO says five extensions give a maximum of 36 months from the notice of allowance. The business days calculator helps you count toward a deadline.
Comparing Attorney Quotes
Switch the attorney fee between flat and per class to compare two quotes on the same filing. The hourly cost calculator helps when a quote is billed by the hour.
Common Trademark Cost Mistakes
1. Budgeting with the Old $250 Fee
TEAS Plus ended on January 18, 2025. The base fee is now $350 per class for everyone filing under Sections 1 and 44.
2. Counting Products Instead of Classes
Ten products in one class cost one fee. One product and one service in two classes cost two fees.
3. Forgetting the Statement of Use
An intent-to-use filing is not finished at $350 per class. The $150 per class use fee is required before registration.
4. Ignoring Maintenance
A registration is canceled or expires if the Section 8 and Section 9 filings are missed. Budget $975 per class for the first 10 years.
5. Treating a Filing Fee as a Guarantee
The USPTO states there is no guarantee a trademark will register. Budget the fee as the cost of applying, not as the price of a registration.
6. Paying a Solicitation That Looks Official
The USPTO warns about misleading notices from private companies. Maintenance fees are paid to the USPTO through its own forms.
Accuracy and Limitations
The USPTO fee math is exact for the schedule in force on the review date. The total is only as good as your surcharge guess and your own attorney quote.
What it calculates accurately
- The $350 per class base application fee
- The 2025 surcharges of $100 and $200 per class
- Statement of use and extension fees for intent-to-use filings
- Section 8 and Section 9 maintenance for the first 10 years
What it does not account for
- Whether your mark will be approved or refused
- Paper filing, Madrid Protocol filing or WIPO fees
- Office action responses, petitions, oppositions or appeals
- Market attorney prices, which you must supply
- Fee changes after the review date
The USPTO says registration usually takes 12 to 18 months. This is general information, not legal advice. Speak to a US-licensed trademark attorney about your own filing.
How We Calculate Trademark Registration Cost
Frequently Asked Questions About USPTO Trademark Costs
How much does it cost to trademark a name with the USPTO?
The base application fee is $350 per class of goods or services when you file online. A name used in one class costs $350 in USPTO fees if the application is complete and uses ID Manual wording.
Is the $250 TEAS Plus fee still available?
No. The USPTO ended TEAS Plus and TEAS Standard on January 18, 2025 and replaced them with one base application fee of $350 per class.
What are the new USPTO trademark surcharges?
There are three. Insufficient information costs $100 per class, free-form text instead of the Trademark ID Manual costs $200 per class, and each additional 1,000 characters of free-form text costs $200 per affected class.
How much does a trademark cost for 2 classes?
The base fee for 2 classes is $700. An intent-to-use filing adds $300 for the statement of use, which makes $1,000 in USPTO fees before any surcharge or attorney cost.
Do I need an attorney to file a trademark?
Not if you are domiciled in the United States. The USPTO requires foreign-domiciled applicants to be represented by a US-licensed attorney. An attorney does not change the USPTO fees but adds a separate cost.
How much does it cost to renew a trademark?
The combined Section 8 declaration and Section 9 renewal costs $650 per class and is due between the ninth and tenth year, then every 10 years.
What does the Section 8 declaration cost?
The Section 8 declaration of use costs $325 per class. It is due between the fifth and sixth year after registration, with a six-month grace period for an extra $100 per class.
How much is an extension for a statement of use?
Each six-month extension request costs $125 per class. The USPTO allows up to five, so five extensions on one class cost $625.
How long does USPTO trademark registration take?
The USPTO says the process usually takes 12 to 18 months. It also says there is no guarantee that a trademark will register.
Does this calculator give legal advice?
No. It adds up published USPTO fees and the costs you enter. It does not judge whether your mark can register or which classes you need.
Is my data saved or sent anywhere?
No. The calculator runs in your browser and nothing goes to our servers. Saved results stay in this browser only.
